Emergence and Evolution of the Cuban Environmental Juridical Thought. Antecedent for the Achievement of the ODS

Abstract

Since the appearance of Homo sapiens until today, man has maintained an intimate relationship with nature to satisfy his needs, a relationship that went from total dependence to a position of power over it, and evolved from the blindest mystification in ages immemorial to the most brutal predation characteristic of our days. Given a precedent nature and scope of the effects of human activities in nature, the protection of the environment today demands an integration of knowledge and this way of conceiving it requires, therefore, all the dimensions of the environmental problem: the historical, philosophical, cultural, ecological, sociological, scientific-technological dimensions and the legal dimension, from which legal-environmental thought arises. Regarding the role of environmental legal thought, novel reflections are handled. In this sense, the main objective of the present work is to present the systematization carried out regarding the emergence and evolution of legal-environmental thought in Cuba, and how its sustained and formative nature laid the foundations of a legal awareness, antecedent for the fulfillment of the SDGs, Agenda 2030. The study of each moment and its evolution was carried out from a qualitative approach, which made it possible to conclude that the taking of an environmental legal conscience allows citizens to participate publicly and consciously in the decision-making and transformation processes of the environmental Issues.
