Autonomy of sports organizations against state control in Ecuador (Original)

Sports organizations in Ecuador are private in nature and constitute a means of developing freedom of association. However, in certain aspects, they are subject to broad state control, which determines the powers of the sectoral ministry in the approval of their statutes, the validation of internal elections, or oversight through the figure of an auditor or a very complex and multi-causal sanctioning regime. This situation determines the existence of a normative tension between the right to autonomy of sports organizations and state control for the effective achievement of the constitutional purposes of the right to sport. Precisely, the analysis of this tension is the central objective of this work. After qualitative study, guided by the methods of documentary review, comparison, and analysis-synthesis, it has been established that when sports organizations do not use public funds or infrastructure, their organizational freedom does not require excessive monitoring and, on the contrary, tends to strengthen their own autonomy. In this regard, a reform of the Law on Sports, Physical Education, and Recreation is proposed to ensure a more precise distinction between the power of state control and/or intervention in sports organizations, redefine the role of the sectoral ministry of sports in such cases, and create a collegiate body responsible for the independent and technical oversight of sports organizations.
