Digital era: the incursion of emerging technologies versus the right to data privacy (Review)

The general objective of this study is to critically analyze how the proliferation of new technologies and the lack of competence in their handling affect data protection in Ecuador. Key new technologies are identified and their impact on privacy is analyzed, highlighting the need for updated legislation. A qualitative approach is used and analytical-synthetic, comparative, literature review and inductive scientific methods are applied. All of them allow to establish a critical argumentative position regarding emerging technologies in the field of data privacy. Thus, regulations on personal data protection, such as the European Union's Data Protection Regulation and other local regulations such as the Organic Law on Personal Data Protection are described and compared. The results denote that, despite the solid framework provided by international regulations, and their implementation in Ecuador, there are still important challenges due to the lack of training on the responsible use of these technologies that aggravates the vulnerability of the right to data privacy of Ecuadorian citizens, concluding that it is necessary to adopt best practices implemented internationally to strengthen data protection in the country.
