The continuous crime and its absence in the Integral Organic Penal Code (Original).

The objective of this scientific article is to analyze the explicit absence of the figure of continued crime in the Integral Organic Penal Code of Ecuador, evaluating the possible harmful implications that this lack of regulation may have in the process of judging crimes that involve his repeated commission. The methodology used in this study is based on a qualitative approach, using methods of bibliographic review, synthetic, exegetical and comparative law analysis. Documentary analyzes of the existing legislation and doctrine on continued crime are carried out, in order to obtain a detailed understanding of the current situation in Ecuador and compare it with the regulations of other countries. The continued crime is a legal figure of great importance, since it allows legally solving situations in which a person commits a series of criminal acts related to each other and that are part of the same plan or criminal purpose. However, despite its relevance, in the Comprehensive Organic Penal Code of Ecuador, there is no specific regulation that defines the elements and requirements of the continued crime, which generates problems of legal certainty and lack of uniformity in the application of the law. criminal justice.
