Impact of the Direct Application of Article 233 on the Principle of Criminal Legality (Review)

This study analyzes the principle of legality within the Ecuadorian legal framework, with a particular focus on its application in criminal law and the crime of embezzlement. It examines how this principle ensures due process and limits the state’s discretionary power in imposing sanctions. The methodology is based on a doctrinal and jurisprudential analysis, comparing constitutional regulations with the Comprehensive Organic Criminal Code. The study explores the relationship between Article 233 of the Constitution and the crime of embezzlement, identifying possible normative contradictions and the need for legislative harmonization. As a conclusion, the study determines that the regulation of embezzlement has been expanded by the Constitution, allowing the prosecution of not only public officials but also third parties involved in the offense. The research highlights the importance of adjusting criminal regulations to ensure coherence with constitutional supremacy and strengthen the fight against corruption. Finally, it proposes a legislative reform to clarify the application of the principle of legality, preventing legal loopholes and ensuring an effective criminal prosecution.
