The present investigation "3% of the contribution to the unemployment of the workers and employers for the financing of the unemployment insurance fund against the constitutional right to social security" whose general objective was: To carry out a critical legal analysis that evidences the necessity of review the regulations to finance the Unemployment Insurance Fund in order to avoid the violation of the constitutional right to social security. The methods used were inductive and deductive, analysis synthesis, logical historical who contributed in the orientation of the entire investigative process, with a sample of 96 lawyers. The results constitute the theoretical contribution for the constitutional right to social security and the right of participation to be consulted, since for decades the processes have been developed, according to the established rules contemplated in the Social Security Law and recognized in the Constitution. of the Republic of Ecuador for the unemployment, but without making a real analysis on the current norms and their possible affectation the regulation is reformed without considering that this restricts the acquired and recognized rights, that is why, we want to carry out an exhaustive analysis on this form of financing.
