Based on the principle of the best interests of children and adolescents, the physical and emotional needs of children must be met in the first instance, even before those of adults. The research problem lies in the fact that possession is a legal figure based on the fact that only one of the parents will be responsible for the care and protection of the child; leaving the other parent subject to a weekly schedule for visits. It is for this reason that it is essential and of great impact in Ecuador to establish shared ownership as a way to guarantee the well-being of the child and adolescent. Within the research, the general objective is to analyze shared ownership based on the best interests of children and adolescents in Ecuador. The methodology used is a qualitative approach, since the characteristics of the problem investigated are described. Likewise, one of the research methods is inductive; Since, it is based on the analysis of general principles such as the best interests of the child, as well as the use of the comparative method, between the legislation of Colombia, Chile and Ecuador, the particular conclusions can be determined.
