The contribution to the unemployment of the workers and employers for the financing of the insurance and unemployment fund. Alternative proposal (Original)

Abstract

The objective of this research is to carry out an exhaustive analysis on the financing of unemployment insurance against the unemployment fund and the constitutional rights for members. The Organic Law for the Optimization of the Labor Day and Unemployment Insurance in a light way was approved without considering that the unemployment that Ecuador faces as a social problem produced by the economic situation of the country, what has been pretended is that with the approval of urgent economic regulation the State deviates from the obligation to continue protecting the rights of all citizens, especially in this case of affiliates. Faced with this normative problem, the legal critical analysis document was created to demonstrate the importance of the State as such in the rights of the affiliates, which although we know that the Ecuadorian Social Security Institute lives by the particular contributions of each citizen, is obligation of the Ecuadorian State to ensure full protection of the right to social security.
