Intercultural dialogue and equality for indigenous judges and authorities in criminal matters

Abstract

The current reality in the lives of indigenous peoples and communities in various aspects, and especially in the subject relevant to this scientific article, is one of instability. This is due to the failure to unify criteria within their communities. Therefore, with the general objective of: Highlighting the violation of the principle of equality between judges of the ordinary justice system and indigenous authorities in Ecuador when conducting intercultural dialogue to resolve the legal situation of indigenous individuals undergoing criminal prosecution. A methodological approach of a qualitative nature and scientific methods such as historical-logical, analytical-synthetic, exegetical, and inductive are applied. Achieving as a result an approach by the Council of the Judicature with the intention of having infrastructure, logistics, and incorporating the most important aspect within the reality experienced by the country and indigenous communities, such as intercultural dialogue and incorporating Legal Pluralism, sheltering within this system.
